Definitions

“Bimstore” means the online database of BIM Components and related content owned, maintained and managed by BIMSTORE PTY LTD.

“BIM Component” means a digital file containing information about a real-world building component or material used in the construction process.

“Content” includes BIM Components and all data, materials, and information available on Bimstore.

“Intellectual Property Rights” means all copyright, trade marks, patents, designs, database rights, trade secrets, know-how and other intellectual property rights anywhere in the world.

Accessing Our Site

Accessing Our Site Access to our site is provided free of charge on a temporary basis. We may suspend, withdraw, or change our site without notice.

We do not guarantee that our site or any content will always be available or uninterrupted.

If you are provided with login credentials, you must keep them confidential. We may disable access if you breach these terms.

You are responsible for:

• ensuring your systems are secure and protected
• ensuring persons accessing the site through your connection comply with these terms
• having authority to bind any organisation you represent.

Content is provided for general information purposes only and does not constitute professional, technical, or construction advice.

You must obtain independent professional advice before relying on any Content.

We may update or change Content at any time without notice and do not guarantee accuracy or completeness.

Unless stated otherwise, all Intellectual Property Rights in the Content and site are owned by BIMSTORE PTY LTD or its licensors.

Licence to Use Bimstore

We grant you a limited, non-exclusive, non-transferable, royalty-free licence to use Bimstore subject to these terms.

You may download BIM Components only for:

1. personal non-commercial use
2. educational use
3. use in drawings or contract documentation relating to construction projects where you are professionally engaged.

You must not:

• create competing services using Bimstore
• copy, adapt, reverse engineer or modify Content
• redistribute or commercially exploit Content
• sublicense or transfer rights without written consent.

User Conduct

You must not upload or transmit material that:

• is unlawful, defamatory, abusive, or offensive
• infringes intellectual property rights
• contains malware or harmful code
• breaches any applicable law or regulation.

We may remove content, suspend accounts, or take legal action for breaches.

Third Party Content and Links

Links to third party websites are provided for convenience only. We are not responsible for their content or availability.

You may link to our site only if the link:

• does not misrepresent your relationship with us
• does not imply endorsement
• complies with applicable laws.

We may withdraw linking permission at any time.

Liability and Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any rights or remedies you may have under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law (ACL) that cannot lawfully be excluded.

Where liability cannot be excluded but may be limited, our liability is limited (at our option) to:

• resupplying the services; or
• payment of the cost of resupply.

To the maximum extent permitted by law, we exclude all other warranties, representations, or guarantees.

We are not liable for:

• loss of profits, revenue, business or data
• indirect or consequential loss
• reliance on Content
• use of BIM Components in construction decisions.

BIM Component specifications reflect information available at publication and may change without notice.

Indemnity

You agree to indemnify BIMSTORE PTY LTD against all claims, losses, damages, liabilities and costs arising from:

• your breach of these terms
• misuse of the site or Content
• infringement of third party rights.

Privacy

We collect and process personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

Variation

We may amend these terms at any time by updating this page. Continued use of the site constitutes acceptance of changes.

Governing Law

These terms are governed by the laws of New South Wales, Australia.

You submit to the exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.

Severability

If any provision of these terms is held invalid, the remaining provisions remain in full force.

Third Party Rights

These terms do not create rights enforceable by any third party.
